Terms of Service
1. Acceptance of terms
By accessing or using thinklab.co (the “Site”) or contracting Thinklab’s services, you agree to these Terms of Service (“Terms”). If you disagree with any part, do not use the Site or services.
2. Description of service
Thinklab provides consulting services in the areas of AI & Product Growth, including Growth & Go-to-Market strategy, Analytics & Experimentation, and AI & Automation. Specific service scope, deliverables, timelines, and fees are defined in individual Statements of Work (SOW) or consulting agreements executed with each client.
3. Eligibility
To engage Thinklab’s services, you must be at least 18 years old and have the legal authority to enter into contracts on behalf of yourself or your organization.
4. Intellectual property
Our IP: All content on the Site — including text, graphics, logos, methodologies (including the PGS � Product Growth System), and frameworks — is the property of Thinklab or its licensors and is protected by intellectual property law.
Your IP: Any information, data, or materials you provide to Thinklab for service delivery remain your property. You grant us a limited license to use such materials solely for the purpose of delivering contracted services.
Deliverables: Ownership of deliverables (reports, audits, implementations) is defined in individual SOWs.
5. User conduct
You agree not to:
- Use the Site for any illegal purpose
- Attempt to disrupt, damage, or gain unauthorized access to the Site
- Reverse engineer, copy, or redistribute Thinklab’s proprietary frameworks or materials without permission
- Impersonate any person or misrepresent your affiliation
6. Fees and payment
Service fees are defined in individual SOWs. Unless otherwise agreed:
- Invoices are due within 15 days of issue
- Late payments may incur interest as permitted by law
- Fees are non-refundable unless explicitly stated
7. Confidentiality
Thinklab and clients treat shared business, product, and strategic information as confidential. Specific confidentiality terms are detailed in individual consulting agreements or separate NDAs.
8. Disclaimers
Services are provided “as is.” While we apply rigorous methodology and senior expertise, we do not guarantee specific business outcomes (revenue, user growth, conversion lifts). Growth results depend on multiple factors, many outside our control.
The Site may contain links to third-party tools, articles, or resources. We are not responsible for third-party content or services.
9. Limitation of liability
To the maximum extent permitted by law, Thinklab’s total liability for any claim arising from the Site or services is limited to the fees paid by the client during the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or business interruption.
10. Indemnification
You agree to indemnify and hold Thinklab harmless from claims arising from your breach of these Terms, your misuse of the Site or services, or your violation of third-party rights.
11. Termination
Either party may terminate consulting engagements per the terms of individual SOWs. For Site usage, Thinklab reserves the right to suspend access for any user who violates these Terms.
12. Governing law
These Terms are governed by the laws of Mexico City, Mexico, without regard to conflict-of-law principles. Any disputes will be resolved in the competent courts of Mexico City, Mexico.
13. Changes to these terms
We may update these Terms periodically. Material changes will be communicated on this page. Continued use of the Site after changes constitutes acceptance.
